With China set to outperform the US as the world?s largest smartphone market, international industry tycoons such as Apple, Microsoft, and Nokia are looking to China as their next target for market growth. Chinese handset manufactures are well aware of the tactics typically used by these giants to strong arm their way into a territory and are starting to mount a defense to protect their interests.

Lenovo, ZTE, TCL, Coolpad, and Konka have formed an alliance in order to collectively ?lawyer-up? when potential patent infringements lawsuits strike. Sources have drawn attention to the fact that companies like Huawei, who was previously a target of one of Microsoft?s threats, and ZTE own numerous wireless communications patents and would be able to present a surmountable defense, even in the face of international giants such as Microsoft, Apple, and Nokia.

Perhaps just the forming of this alliance will make some companies think twice before pulling the trigger on a patent war in China, but if history is any indication of the future, Chinese vendors will most likely find themselves defending their interests in the near future.

Can foreign tourists help US economy? (AP)

LAS VEGAS ? Agustina Ocampo is the kind of foreign traveler businesses salivate over.

The 22-year-old Argentine recently dropped more than $5,000 on food, hotels and clothes in Las Vegas during a trip that also took her to Seattle's Space Needle, Disneyland and the San Diego Zoo. But she doubts she will return soon.

"It is a little bit of a headache," said Ocampo, a student who waited months to find out whether her tourist visa application would be approved.

More than a decade after the federal government strengthened travel requirements after the Sept. 11, 2001, terrorist attacks, foreign visitors say getting a temporary visa remains a daunting and sometimes insurmountable hurdle.

The tourism industry hopes to change that with a campaign to persuade Congress to overhaul the State Department's tourist visa application process.

"After 9/11, we were all shaken and there was a real concern for security, and I still think that concern exists," said Jim Evans, a former hotel chain CEO heading a national effort to promote foreign travel to the U.S.

At the same time, he said, the U.S. needs "to be more cognizant of the importance of every single traveler."

Tourism leaders said the decline in foreign visitors over the past decade is costing American businesses and workers $859 billion in untapped revenue and at least half a million potential jobs at a time when the slowly recovering economy needs both.

While the State Department has beefed up tourist services in recent years, reducing wait times significantly for would-be visitors will likely be a challenge as officials try to balance terrorist threats and illegal immigration with tight budgets that limit hiring.

"Security is job one for us," said Edward Ramotowski, managing director of the department's visa services. "The reason we have a visa system is to enforce the immigration laws of the United States."

Anti-immigration proponents argue travel to the U.S. is already too accessible and that allowing more visitors would put the nation at greater risk.

"Everybody would like to find a way to admit as many people as possible to visit here providing that they visit and then go home," said Jessica Vaughan, director of policy studies at the Center for Immigration Studies, an anti-immigration group based in Washington, D.C.

"A lot of consular officers underestimate how much people want to come and live here," she said.

Nearly 7.6 million nonimmigrant visas were issued in 2001, compared with fewer than 6.5 million in 2010. The number of visa applicants also dropped sharply after 2001. Those combined forces pushed the U.S. share of global travelers down to 12 percent last year, from 17 percent before 2001.

The proposed immigration overhaul has largely been driven by the U.S. Travel Association, the tourism industry's lobbying giant, and has been endorsed by business titans such as the National Retail Federation, Four Seasons Hotels and Resorts, and Walt Disney Parks and Resorts. Republicans and Democrats in Congress are backing the proposed changes through six bills in the House and Senate.

Geoff Freeman, the travel association's chief operating officer, said the State Department should be required to keep visa interview wait times at a maximum of 10 days.

"Every day a person is waiting for that interview is a day a person cannot be here supporting the American economy," he said.

For most foreigners, taking a last-minute business or leisure trip to New York, Los Angeles, Miami or other U.S. travel hubs would be nearly impossible. The average wait time for a visa interview in Rio de Janeiro, for example, was 87 days, according to the State Department.

The Government Accountability Office, a nonpartisan agency that audits federal programs, concluded that wait times are likely much longer than reported because some department employees artificially reduce the wait times by not scheduling interviews during high-demand periods.

The vast majority of visitors enter through the country's visa waiver program, which allows travelers from 36 nations with good relationships with the U.S. to temporarily visit without a visa. Travel proponents want to add nations whose residents are unlikely to illegally move to the U.S., including Argentina, Brazil, Poland and Taiwan.

Tourists from the rest of the world, including India, China, Mexico and other nations with affluent travelers looking to use their passports, must obtain a nonimmigrant visa. The process can be expensive and time-consuming.

People living far from a visa processing center must arrange travel to the interview location, not knowing whether they will be approved. Roughly 78 percent of all tourist visas were approved so far in 2011.

Tourism proponents want the department to embrace videoconferencing as a way to interview more people quickly. The department has no plans to implement videoconferencing interviews because of safety and technological concerns, Ramotowski said.

In-person interviews weren't the norm before 9/11, when consular officials had the authority to approve travelers based on an application alone. Since then, however, screenings have become more strenuous, with fingerprint checks and facial recognition screening of photographs.

The State Department has made moves to boost its tourist services in recent years, transferring employees from underworked offices to bustling embassies and consular posts. Many visa processing centers are also operating under extended hours.

Other proposed changes include granting more multi-entry visas and charging premium fees to tourists who want a visa right away, similar to the premium passport fee charged to Americans with last-minute passport requests. The tourism industry also wants more visa processing officers and to allow travelers to submit applications in their native language.

"We can't afford to treat them in a way that gives them an impression that maybe they aren't welcome," said Rolf Lundberg, the U.S. Chamber of Commerce's top lobbyist.

To help make the U.S. appear more welcoming, Congress approved last year a $200 million annual marketing campaign.

In Las Vegas, where travelers to the Strip have traditionally kept Nevada's economy afloat, tourism and government leaders are desperate to keep businesses open and create jobs in a state with the nation's highest unemployment rate.

"The industries affected by tourism are all behind it," said Republican Rep. Joe Heck of southern Nevada, who has sponsored a bill in the House that would require shorter visa interview delays, among other measures. "We need the jobs."

Ocampo, who spent her vacation shopping at upscale boutiques and visiting family in California, said she would be more eager to come back if she knew her business was wanted.

"Everyone wants to visit the Statue of Liberty and Disneyland," she said.

Infographic: Our Military?s Dangerous Course

The U.S. military is on a dangerous course. Under the projected defense spending caps brought on by the Budget Control Act of 2011,?funding for modernizing the military will be squeezed to a dangerous degree. That includes reduced spending on the procurement of new weapons and equipment and research and development on new defense technologies as the infographic below shows. (Article continued below.)

In a new paper, Heritage?s?Baker Spring, the?F. M. Kirby Research Fellow in National Security Policy, explains the impact the reduced funding will have on America?s defenses:

The result will be a military that lacks the modern weapons and equipment it needs, loses its technological edge over future enemies, and finds itself dependent on a seriously eroded defense industrial base.

As a result of the twin pressures of the estimated spending caps on the core defense program derived from the Budget Control Act . . . and the rising cost of military compensation, the level of funding for military modernization will necessarily fall to unacceptably low levels. Under this scenario, funding for defense modernization within the core defense program . . . ?could fall to roughly $145 billion in current dollars in FY 2016.

How does that compare to where the military would have otherwise been? Spring says that under?President Obama?s original budget request for FY 2012,?$188.4 billion was to be allocated to these accounts ? meaning that?modernization funding will decline by?$43 billion,?or 23 percent, over the four-year period. If you control for inflation, that?s a?29 percent decline.

Spring says that?s an unacceptable course and he recommends that Congress 1)?Prevent application of the national security and discretionary spending caps under the Budget Control Act to the DOD budget; and 2)?Restructure the military health care and retirement systems to free money inside the DOD budget for application to the modernization account.

(AP) ? Americans probably won't be seeing a huge ticker-tape parade anytime soon for troops returning from Iraq, and it's not clear if veterans of the nine-year campaign will ever enjoy the grand, flag-waving, red-white-and-blue homecoming that the nation's fighting men and women received after World War II and the Gulf War.

Officials in New York and Washington say they would be happy to help stage a big celebration, but Pentagon officials say they haven't been asked to plan one.

Most welcome-homes have been smaller-scale: hugs from families at military posts across the country, a somber commemoration by President Barack Obama at Fort Bragg in North Carolina.

With tens of thousands of U.S. troops still fighting a bloody war in Afghanistan, anything that looks like a big victory celebration could be seen as unseemly and premature, some say.

"It's going to be a bit awkward to be celebrating too much, given how much there is going on and how much there will be going on in Afghanistan," said Don Mrozek, a military history professor at Kansas State University.

Two New York City councilmen, Republicans Vincent Ignizio and James Oddo, have called for a ticker-tape parade down the stretch of Broadway known as the Canyon of Heroes. A similar celebration after the Gulf War was paid for with more than $5.2 million in private donations, a model the councilmen would like to follow.

Mayor Michael Bloomberg said last week that he was open to the idea but added, "It's a federal thing that we really don't want to do without talking to Washington, and we'll be doing that."

A spokesman for the mayor declined to elaborate on the city's reasons for consulting with Washington. Ignizio said he had been told by the mayor's office that Pentagon officials were concerned that a celebration could spark violence overseas and were evaluating the risk.

Navy Capt. John Kirby, a Pentagon spokesman, said that he has not heard that issue raised and that New York has yet to make a formal proposal. He also said officials are grateful communities around the country are finding ways to recognize the sacrifices of troops and their families.

The last combat troops in Iraq pulled out more than a week ago. About 91,000 U.S. soldiers, sailors, airmen and Marines are in Afghanistan, battling a stubborn Taliban insurgency and struggling to train Afghan forces so that they eventually can take over security. Many U.S. troops who fought in the Iraq War could end up being sent to Afghanistan.

A parade might invite criticism from those who believe the U.S. left Iraq too soon, as well as from those who feel the war was unjustified. It could also trigger questions about assertions of victory.

Mrozek noted that President George W. Bush's administration referred to military action in the Middle East as part of a global war on terror, a conflict that's hard to define by conventional measures of success.

"This is not a war on a particular place or a particular force," he said.

Bush himself illustrated the perils of celebrating milestones in the war, Mrozek said, when he landed on an aircraft carrier and hailed the end of major combat operations in Iraq behind a "Mission Accomplished" banner in May 2003. U.S. troops remained in Iraq for 8? more years, and Bush was criticized over the banner.

The benchmarks were clearer in previous wars. After World War II, parades marked Japan's surrender. After the Gulf War, celebrations marked the troops' return after Iraqi forces were driven out of Kuwait.

The only mass celebrations of U.S. military activities since Sept. 11, 2001, were largely spontaneous: Large crowds gathered in Times Square and outside the White House in April after Osama bin Laden was killed.

At the same time, Iraq veterans aren't coming home to the hostility many Vietnam veterans encountered. The first large-scale event honoring Vietnam veterans was not held until 1982, when thousands marched in Washington for the dedication of the Vietnam Veterans Memorial. Parades were later held in New York in 1985 ? 10 years after the war ended ? and in Chicago the next year.

"I think we've seen recent history in Vietnam, where that wasn't done appropriately, and we want to make sure we do the appropriate thing by those that made the ultimate sacrifice and risked their lives for us to say thanks," Ignizio said.

At Fort Hood in Texas, troops have returned to welcome-home ceremonies at the post that were attended mostly by soldiers' families. Soldiers in uniform run to hug their loved ones after an announcer yells, "Charge!"

Col. Douglas Crissman, commander of the 3rd Brigade of the 1st Cavalry Division, said Saturday after one such ceremony that that is as large-scale a welcome as the troops need.

"This is just the right size because it's quick and meaningful and it gets them home to their families," Crissman said.

Staff Sgt. Troy Rudolph was among the first troops to arrive in Iraq in March 2003 and was in the last combat brigade to leave. Rudolph said that a large-scale ceremony would be nice but that he feels appreciated even without confetti falling from the sky.

"I've had people buy me lunch at airports just because I was in uniform," said Rudolph, who lives at Fort Hood with his wife and 9-year-old stepdaughter. "It's emotional because you don't realize what kind of impact you have on people across the country."

In Washington, federal agencies take the lead on planning parades, and so far nothing is in the works. A spokesman for Mayor Vincent Gray said the city would be honored to host a parade but said local officials wouldn't take the lead in staging one.

In recent years, most of the ticker-tape parades in New York have been held for the city's championship sports teams.

"The sports celebrations that we've had in New York for the Yankees and the Mets were amazing," Oddo said. "But these are the real heroes."

NEW ORLEANS ? Matt Ryan hit nine of his first 12 passes for 120 yards, including a 21-yard scoring strike to Julio Jones that gave the Atlanta Falcons a 10-7 lead over the New Orleans Saints after one quarter on Monday night.

Both teams scored on all of their possessions in the opening quarter, with the Saints briefly pulling in front 7-3 on Pierre Thomas' 4-yard touchdown run, after which he pulled a bow from his uniform pants, put it on the football and offered it as a gift to a woman with a parasol in the front row behind the end zone.

The referees weren't cutting Thomas any slack on his Christmas-themed celebration, flagging him for a 15-yard unsportsmanlike conduct penalty.

The score capped an eight-play, 84-yard scoring drive on which Drew Brees completed two passes for 49 yards as he closed in on Dan Marino's 1984 single-season yards passing record of 5,084. Brees entered the game needing 305 yards to pass Marino's mark.

The Saints entered the game needing only one victory to clinch the NFC South title, while Atlanta could remain in the hunt to defend its 2010 division crown with a win.

After Atlanta received the opening kickoff, Ryan completed five of his first six throws for 52 yards, including a 20-yard completion to Roddy White at the New Orleans 23. The Saints' defense stiffened there, however, forcing Atlanta to settle for Matt Bryant's 34-yard field goal and an early 3-0 lead.

The Saints responded immediately, with Brees hitting Lance Moore for a 38-yard gain on New Orleans' first play from scrimmage. The Saints then went to the running game, with Chris Ivory rushing one time for 11 yards and Thomas three times for 24 yards, including his short TD run.

Thomas' unsportsmanlike conduct penalty, enforced on the ensuing kickoff, was not terribly costly, as Eric Weems returned it to the Atlanta 28. More costly was the Saints inability to slow down Ryan, who quickly found Jones for a 25-yard gain and White for 16 yards to set up the scoring pass to Jones.

Aide to top Mexican drug boss Guzman captured (Reuters)

MEXICO CITY (Reuters) ? The Mexican defense ministry on Monday paraded before the media a man suspected of being a senior aide to the country's most wanted drug trafficker, Joaquin "Shorty" Guzman, the boss of the powerful Sinaloa cartel.

In a statement, the defense ministry said Mexican soldiers had arrested Felipe Cabrera, known as "el Inge", in Culiacan, capital of Sinaloa, the northwestern Pacific state after which Guzman's drug cartel is named.

Cabrera, whose nickname is an abbreviation of the Spanish word for engineer, was the second suspected Guzman lieutenant to be seized in Culiacan in the past two months. In October, the army captured a third Guzman ally in the city.

President Felipe Calderon's conservative administration has been dominated by his military crackdown against drug cartels, which has claimed over 45,000 lives in the past five years, eroding support for his National Action Party, or PAN.

The government has captured or killed dozens of senior drug smugglers, but Guzman, the most notorious, still eludes Calderon.

The defense ministry said Cabrera was in charge of the Sinaloa cartel's operations in the neighboring state of Durango, a Guzman bastion where he has been rumored to live.

It added that Cabrera also had responsibility for the southern part of the border state of Chihuahua, through which many drugs are smuggled into the United States.

Cabrera, who allegedly headed Guzman's personal security in the Durango area, is suspected of involvement in a host of violent crimes ranging from arson to kidnapping and extortion.

The government didn't say when Cabrera was captured. He was paraded before the media in Mexico City on Monday, a common practice after a noted drug cartel suspect is captured.

Guzman runs an empire of methamphetamine, marijuana and cocaine smuggling that has earned him a spot on Forbes magazine's list of billionaires.

'Project Hope' Helps Former Soviet Union Kids

During the Christmas season, Christians are encouraged to turn their focus to others, helping those who are most vulnerable and in need.

The former Soviet Union is one area where children are suffering -- many of them living without parents in poor conditions.

Russian Ministries is working to ensure these little ones have something to smile about this Christmas through its "Project Hope" effort.

Churches and volunteers help prepare and distribute gift boxes filled with toys, candy, coloring books, a children's Bible, and other items to needy children in the region.

"There are about 700,000 orphans living in orphanages," said Russian Ministries?President Sergey Rakhuba.

"It helps these children to know there is hope for the future and there is someone out their who cares for them," he added.

Russian Ministries partners with local churches to spread the gospel, train leaders and minister to the poor.

Google's Andy Rubin defines 'Android activation,' trumpets 700,000 per day clip

Looking for growth? You've found it. If you'll recall, Google's own Senior Vice President of Mobile Andy Rubin confirmed that over 500,000 Android devices were being activated back in June, and during last month's Galaxy Nexus reveal, we learned that said figure had increased to 550,000 per day. In just over a month, the tally has now climbed to 700,000 per 24 hour period. That's according to a post by Andy himself on Google+, which he followed with this:

"For those wondering, we count each device only once (i.e., we don't count re-sold devices), and "activations" means you go into a store, buy a device [and] put it on the network by subscribing to a wireless service."

In other words, there are many, many more Android devices being ushered into use every single day that don't connect to any monitored wireless service, but naturally, keeping track of those is something even Google isn't about to attempt. Any guesses as to what this figure jumps to after the holiday season concludes?

Indie market bounces back with "Twilight" and "King's Speech" (Reuters)

LOS ANGELES (TheWrap.com) ? Thanks to monster hits like "The Twilight Saga: Breaking Dawn -- Part 1" and art-house breakouts such as "The Artist," many of the major players in the independent film market racked up an impressive year despite the industry-wide box office decline.

The top seven indie studios grossed $1.57 billion at the domestic box office so far this year, compared to $1.52 billion in 2010, according to Boxofficemojo.com.

Theatrical revenues grew while studios continued to exploit video on demand and digital video as a new source of revenue. Barely a week goes by without one or more of the indies signing a new streaming pact with the likes of Netflix or Hulu.

So who's leading the pack? Summit dominated market share thanks to the latest installment in its tween horror romance, "Twilight." Relativity announced itself as a major player on the scene, but next year will need to find a new source of financial backing in order to stay there.

The Weinstein Co. re-emerged from its 2010 refinancing with the wind at its back thanks to Colin Firth's stuttering monarch in "The King's Speech."

Fox Searchlight is translating the critical raves for Alexander Payne's "The Descendants" into solid box office returns.

New entrant FilmDistrict scored a low-budget hit with the $54 million domestic grossing horror film "Insidious," but overspent on Johnny Depp's "The Rum Diaries, with only a measly $13 million at the domestic box office to show for its troubles.

Likewise, Focus Features churned out a genre hit with the $40 million grossing "Hanna," but couldn't interest audiences in the $19.4 million grossing Roman epic "The Eagle."

Not every studio was a winner. Lionsgate, with a costly string of box office misses, saw its numbers fall to earth. But salvation may be just around the corner in the form of a certain dystopian young adult novel, "The Hunger Games."

Here's a look at the top four indie studios:

SUMMIT

"The Twilight Saga: Breaking Dawn -- Part 1" powered the studio's slate, grossing a bloody good $658.4 million worldwide -- and counting -- on a $110 million budget. The finale to the sex and blood sucking series hits next summer, at which point the studio will be hard-pressed to find an equally profitable series of projects to replace it.

After all, that film accounted for more than 50 percent of Summit's $1 billion worldwide gross.

The rest of Summit's slate was something of a mixed bag. Cancer comedy "50/50" rode strong reviews to a $34.9 million domestic gross while "The Three Musketeers" deflected critical knocks to rack up $139 million worldwide. Also performing solidly was the mind-bending thriller "Source Code," which generated $146.7 million globally on a $32 million budget.

However, Nicolas Cage's "Drive Angry 3D" grossed a meager $10.7 million on a $9 million budget, and Mel Gibson's "The Beaver" couldn't overcome its star's controversial public image to bank a dreadful $8.7 million on a $21 million budget.

Maybe it's time to start plotting "The Twilight Saga: The Early Years."

LIONSGATE

"The Hunger Games" can't come soon enough for Lionsgate after a dreadful 2011.

The studio was hit hard by a series of flops last summer and fall, after audiences rejected "Conan the Barbarian," "Warrior," "The Devil's Double" and "Abduction" in short order.

Given that those films represented 50 percent of Lionsgate's theatrical slate, the bad grosses were magnified. Last year, the studio released substantially more films -- 14 theatrical releases in total, among them such moneymakers as "The Expendables" and "The Last Exorcism."

The year wasn't a total wash with the studio fielding two solid performers with "The Lincoln Lawyer" ($58 million, domestically) and "Tyler Perry's Madea's Big Happy Family" ($53 million, domestically).

Still, theatrical revenues plunged from $510.8 million domestically to $175.7 million this year.

"On the film side, it was one disaster after another," James Marsh, an analyst at Piper Jaffray & Co., told TheWrap. "There's a huge amount riding on 'Hunger Games.'"

Most analysts believe next spring's "Hunger Games" will be the company's highest grossing film of all time and could launch a multi-part franchise.

The studio and its stock have been re-energized in recent months now that Carl Icahn has abandoned his long standing attempt hostile takeover attempt of the studio and sold virtually all of his stock in the company.

The studio has done an expert job of monopolizing digital streaming and other alternative home-entertainment platforms through deals with Netflix. In particular, "Margin Call," the financial meltdown drama produced with Roadside Attractions, has become an unlikely hit for the studio, grossing $5 million domestically and $5 million on day-and-date video on demand.

Also on tap are a sequel to "The Expendables," Arnold Schwarzenegger's big screen return in "The Last Stand," and the Cameron Diaz and Jennifer Lopez romantic comedy "What to Expect When You're Expecting."

RELATIVITY

The end of Relativity's first year as a full-fledged film production and distribution company was marred by a series of executive departures and reports of financial difficulties.

That said, the studio fielded a number of solid box office performers, including "Immortals," the studio's sword-and-sandals epic has grossed $195 million worldwide to date with major territories yet to open including Spain and Latin America.

The pill-popping thriller "Limitless" was a surprise hit last spring, racking up $165.4 million globally on a $27 million production budget.

Not that Relativity didn't have its share of duds. Family comedy "Judy Moody and the NOT Bummer Summer" grossed a lowly $15 million on a $20 million budget, while the long-shelved "Take Me Home Tonight" grossed a paltry $6.9 million domestically. ("Judy Moody" was financed by Smokewood Entertainment, not Relativity.)

More troubling is the potential departure of Relativity President Steve Bertram, who may leave the company when his contract is due up at the end of the year. His exit would be the latest in a string of exits among the studio's top ranks. CEO Ryan Kavanaugh's inability to find a new backer to replace outgoing investor Elliot Management is another concern.

But the studio is proud that in its first year every one of its home-grown projects either broke even or made a profit.

THE WEINSTEIN CO.

"The King's Speech" has been a royal winner for the Weinstein Co.

Snatching Best Picture from the grip of "The Social Network" reaped big dividends for the indie studio, with the drama raking in $414.2 million worldwide.

The rest of the studio's slate hasn't been nearly as impressive, although Harvey and crew clearly think they may have another Best Picture winner on their hands with "The Artist." The black-and-white silent film -- bought for a song (get it?) at the Cannes Film Festival -- has grossed $15.4 million worldwide so far, but business should ramp up if the movie is an Oscar winner.

Thanks in large part to that little gold statue, the studio more than quadrupled its previous year's box office take, earning $547 million as opposed to the $89.7 million banked in 2010.

Although "Scream 4" signaled that that the bottom has probably fallen out of the horror film franchise, it still was profitable with a $97 million worldwide gross on a $40 million budget. Ditto for "Spy Kids: All the Time in the World," which grossed a modest $74 million, but only cost $27 million to produce.

The jury is still out on "My Week With Marilyn," which has grossed nearly $10 million so far, but could add to its take if it picks up awards attention.

Looking ahead, the studio has Quentin Tarantino's slave era spaghetti western "Django Unchained," Brad Pitt's crime thriller "Coogan's Trade," and Shia LaBeouf's prohibition drama "The Wettest Country in the World."

"We're very focused -- that's the message," David Glasser, TWC's chief operating officer, told TheWrap. "There's a need and a desire for the kind of movies that we make."
